The National Standard for Licensing Persons Performing High Risk Work (HRW), April 2006 (the National Standard) aims to facilitate the operation of a nationally uniform, competency-based licensing system for persons performing certain types of high risk work. It replaces the National Occupational Health and Safety Certification Standard for Users and Operators of Industrial Equipment [NOHSC: 1006 (2001)] originally declared in 1992, which was adopted in OHS regulations throughout Australia.

Regulations

Relevant regulations dealing with HRW and licensing in Victoria are OHSA Regulations -2007 3.6 High Risk Work and 6.1 Licences. OHSA Act and other regulations may also apply.

In general, in relation to HRW & licensing, the regulations provide:

  1. Employer must not use unlicensed employees to do high risk work. Subject to regulation 3.6.1, a person must not do any high risk work unless he or she holds an appropriate high risk work licence in relation to the work.

  2. 3.6.2 An employer must not allow an employee to do any high risk work unless the employee holds an appropriate high risk work licence in relation to that work.

These regulations, together with a consistent approach to competency standards for operators and the National Licensing System, provide workplaces and the general public with an assurance that the certificate holders have been assessed as having the necessary basic skills to carry out the work, safely.
